By installing, copying, activating, or using the Software, the Licensee accepts this EULA. Otherwise it must not be installed or used. Mandatory statutory and consumer rights remain unaffected.
1. Subject matter
1.1 rsk.dedupe is supplied as executable object code with any electronic documentation. It locally identifies byte-identical files and visually similar photos, creates result groups, displays previews and metadata, offers non-binding recommendations, and can quarantine, restore, or permanently delete files selected and confirmed by the Licensee.
1.2 The product description at the time of purchase defines the agreed features. Planned or preview features, particularly similar videos or burst photos, are not owed unless expressly agreed. The Software is licensed, not sold.
2. Licence grant and use
2.1 A non-exclusive and, subject to mandatory law, non-transferable and non-sublicensable licence is granted to one individual. That person may personally use rsk.dedupe on any number of their own devices. Every additional user needs a licence. Private and business use, including the Licensee’s own services, is permitted provided third parties receive neither the Software nor independent access.
2.2 A backup copy is permitted. Rental, lending, leasing, hosting, SaaS, or other provision to third parties requires consent unless mandatory law provides otherwise. The trial is fully functional for seven days; a valid licence is required afterwards.
3. Copyright and proprietary rights
3.1 The Software, interface, graphics, text, and documentation are protected. Notices must not be removed or altered. Licence keys and activation data must remain confidential and known misuse must be reported.
4. Prohibited acts
4.1 Decompilation, disassembly, reverse engineering, modification, translation, or derivative works are prohibited except where mandatory law permits them. Protection, activation, and licensing mechanisms must not be circumvented. Unlawful use or unauthorised processing is prohibited.
5. Duplicate and similarity detection
5.1 Exact duplicates are identified using technical characteristics, particularly size and content checksum. Similar-photo results use image characteristics and tolerances and are probabilities, not judgments of personal, legal, or economic value.
5.2 Format, resolution, compression, cropping, editing, metadata, decoders, and tolerance may cause false matches or misses. The Licensee must inspect previews and information. Recommendations use technical criteria and are non-binding. Automatic pre-assessment changes only the selection; files are processed only after a cleanup preview and explicit confirmation.
5.3 Displays reflect the detectable state. Concurrent access and later changes may affect results. Protected and excluded paths reduce risk but cannot identify every sensitive location.
6. Quarantine, recovery, and permanent deletion
6.1 Selected files are normally moved into application-managed quarantine first. It is not a backup. Recovery may fail because of permissions, inaccessible locations, naming conflicts, or damaged quarantine data.
6.2 Permanent deletion from quarantine is irreversible and requires an explicit decision. Old quarantine entries are not deleted automatically. Need and independent backups must be checked first. Undo, recovery, quarantine, and history do not replace backups.
6.3 The Licensee is responsible for storage, permissions, accessible locations, and stable systems. Quarantine on the same physical drive does not protect against drive failure.
7. Duties and backups
7.1 Scope, groups, previews, recommendations, selections, paths, and operations must be reviewed. A current, separate, tested backup is required before extensive or potentially irreversible operations.
7.2 The Licensee must verify authorisation and retention, documentation, privacy, and evidentiary duties. Network or power failures, locks, permissions, long paths, defective media, security tools, and synchronisation software may interfere. The Software is not intended for life-, health-, or infrastructure-critical use.
8. Installation, activation, and updates
8.1 The Licensee is responsible for installation and requirements. Each installation requires a one-time internet connection for activation with the licence key. Regular local use then requires neither a permanent connection nor recurring online licence checks. Voluntary online features such as update checks may require internet access.
8.2 Updates or new versions may be provided. Specific enhancements or new major versions are owed only if agreed or required by law. Statutory update and consumer rights remain unaffected.
9. Term and termination
9.1 The licence for the purchased major version is indefinite, without subscription or automatic renewal. Termination for good cause remains possible. On termination, use must cease and unnecessary copies and licence information must be deleted. Statutory ending rights remain unaffected.
10. Defects and warranty
10.1 Statutory rules apply. Error-free operation in every environment, file system, medium, format, and third-party combination cannot be guaranteed. Problems caused by misuse, damaged data, insufficient rights or storage, network, cloud, or third-party failures are not defects attributable to the Licensor. Issues should be reported reproducibly.
11. Liability
11.1 Liability is unlimited for intent, gross negligence, injury to life, body, or health, and mandatory statutory cases. For slight negligence involving an essential duty it is limited to foreseeable, typical loss; data-loss liability is limited to typical restoration cost where proper backups existed.
11.2 Subject to mandatory cases, the Licensor is not liable for unchecked groups or recommendations, confirmed quarantine or deletion, missing backups, defective media, network or cloud disruption, concurrent access, malware, or third-party software. Limits also benefit representatives, employees, and agents.
12. Data security and privacy
12.1 The Licensee is responsible for separate, risk-appropriate backups. Scanning, comparison, recommendations, and file operations run locally; scanned files are not sent to the Licensor and the Software contains no telemetry. Local diagnostics and history may contain paths, times, decisions, and errors.
12.2 Technically necessary data may be processed for activation, update checks, diagnostics, and support under the published privacy information. The Licensee is responsible for personal data in scanned files and must protect systems, accounts, media, quarantine, and backups.
13. Third-party components and services
13.1 Additional terms may govern third-party and open-source components. Operating systems, file systems, networks, cloud storage, decoders, preview handlers, and external applications may be subject to provider terms; the Licensor does not warrant their availability or freedom from defects.
14. Transfer
14.1 Transfer requires consent unless mandatory law, including exhaustion principles, permits otherwise. On a permitted permanent transfer, the former Licensee must cease use, delete copies, and provide the licence information needed for lawful use.
15. Changes to this EULA
15.1 The version incorporated at purchase generally governs the acquired Software version. A new EULA may apply to future versions, functions, or contracts. Existing contracts may be changed only with consent unless mandatory law permits otherwise.
16. Final provisions
16.1 German law applies without the CISG. Mandatory consumer protection in the consumer’s habitual-residence country remains unaffected. Where lawful, the Licensor’s registered office is the venue for merchants and public-law entities. Invalid clauses do not affect the remainder; individual agreements and statutory form requirements prevail.
